Please read these Terms of Service ("Terms") carefully before using the Scently mobile application or website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 16 years of age to use the Service. By using Scently, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@scentlyapp.co if you suspect unauthorized access.
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.
Scently offers a free tier and a paid subscription plan ("Scently Pro"). By subscribing, you agree to pay the applicable fees. All payments are processed through Apple App Store or Google Play and are subject to their respective payment terms.

You may submit content to the Service, including profile photos and scent notes. By doing so, you grant Scently a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service.
You represent that you own or have the necessary rights to the content you submit, and that it does not violate any third-party rights or applicable laws.
The Service, including its software, design, text, graphics, logos, and content, is owned by Scently and protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.
You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
The Scent Twin feature connects you with other users who share similar scent preferences. Scently does not conduct background checks on users and is not responsible for the conduct of any user, online or offline. Exercise discretion and good judgment when interacting with other users.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Fragrance descriptions and recommendations are provided for informational and discovery purposes only. Scently is not affiliated with any perfume brand or retailer unless explicitly stated.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCENTLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $10, whichever is greater.
You agree to indemnify and hold harmless Scently and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will continue to apply.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, by sending an in-app notification. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts.
